Digital identification, electronic signatures and trust services
Pedro de Miguel Asensio
Chapter 7 in EU Digital Law, 2026, pp 511-543 from Edward Elgar Publishing
Abstract:
The EU legal framework has evolved from merely regulating electronic signatures to a much broader instrument covering electronic identification and other trust services. This chapter presents Regulation (EU) No 910/2014, as amended to provide for a European Digital Identity Wallet. The distinction between qualified and non-qualified trust services and the implications of these developments for further digitalisation in other areas are presented. The chapter also discusses the graduated system of various electronic signatures and their legal effects and evidential value under Regulation (EU) No 910/2014. Finally, other relevant trust services are also presented.
