Abstract:
This chapter is devoted to common provisions relating to the examination as to jurisdiction and admissibility, lis pendens and related actions and provisional measures. Within the context of lis pendens and related actions, the revised rule on lis pendens and its shortcomings, as well as the new provisions on lis pendens in third States introduced by the Recast are discussed in a great detail. The same holds true with respect to a dual regulatory scheme for provisional measures introduced by the Recast. Potential problems in interpretation and application amongst the EU Member States are particularly examined.
