ESG data and EU competition enforcement: From “green” to “digital” antitrust in sustainable markets

Abstract: This chapter questions how ESG data arrangements among businesses, currently advanced by the European ESG regulations, stand to currently evolving European competition policy, as moved by the recalled “twin enforcement transition.” Taking the case of ESG data exchanges among undertakings, the analysis aims at tracing the role of competition enforcement in respect to sustainability-related information markets. The chapter thus approaches the overall theme of the Research Handbook on Data, Privacy and Competition Law, questioning the link between data regulations and competition law in the general context of sustainable markets and of sustainability-related data markets more specifically. The starting assumption of the reflection is given by the twofold factual dimension of emerging ESG-related data markets: on the one hand these markets pursue a declared sustainability objective, namely the advancement of market operators’ understanding of ESG parameters; on the other hand, resulting agreements among undertakings regard digital assets, namely technological tools that are capable of “reading” ESG factors and resulting datasets.
