Abstract:
States generally define criteria which migrants have to fulfill who intend to stay permanently or for certain periods longer than just short-term visits. Receiving societies determine criteria for the social acceptance of migrants. This acceptance and the willingness of the societies is a key element of social cohesion. Research about integration requires the inclusion of several disciplines. The legal sources play an important role as the basis for a successful integration and stability of societies. States have to respect their human rights obligations and especially the various obligations not to discriminate against non-nationals. On the universal level, the Global Compact for Migration (GCM) adopted by the General Assembly of the United Nations in 2018 strongly focusses on integration. Objective 16 of the GCM has the heading ‘Empower migrants and societies to realize full inclusion and social cohesion.’ On a regional level and also in the European Union (EU) only a few legal sources – mainly non-binding ones – dealing with integration have been adopted. Integration criteria and measures to promote integration are mainly contained in national laws. Though the EU's legislative competence in the area of integration is limited, recent developments show that the importance of integration for a successful migration policy is receiving increased attention.
