Abstract:
The migration process for a child is fundamentally different from that of an adult. The process is further influenced by factors such as whether the child is migrating voluntarily or involuntarily, as well as their status as an accompanied or unaccompanied minor, alongside their age and gender. This encyclopedia entry delves into the international legal framework that protects child migrants by looking at the general and specific rights entitled to the child in this context. Further, it explores the challenges faced by child migrants, including gaps in legal frameworks and issues of interpretation and implementation. It reviews the effectiveness of the implementation of the Convention on the Rights of the Child (CRC) in the context of migration and whether it is successful in protecting the rights of child migrants.
