Abstract:
Who is a refugee and who is entitled to protection are critical questions for states seeking to manage movement across their borders. On occasion, as in the case of Ukraine, the answers are deemed obvious notwithstanding the numbers displaced, but, in others, considerable time and resources are expended in determining, on an individual basis, whether someone comes with the refugee definitions provided by international law. The historical background to refugee protection is briefly examined, which is then followed by a summary of the legal definitions adopted in various regions, an analysis of the key elements of ‘inclusion’ and ‘exclusion’, and an indication of some of the remaining challenges in regard both to problems of interpretation and to the obligation on states to provide protection in accordance with human rights.
