Chapter 20 in Research Handbook on European Constitutional Law, 2026, pp 347-373 from Edward Elgar Publishing

Abstract: The chapter considers the involvement of EU (and national) institutions in the exercise of the EU legislative powers starting from the statics, that is the institutional framework and the principle of representative democracy. Second, it delves into the euro-national procedures for the exercise of the legislative authority in between the EU and the Member States, analysing their design and practice. Third, it critically assesses the challenges faced by the exercise of legislative powers in the EU. Finally, the contribution concludes in favour of the consolidation of a composite understanding of legislative powers in the Union.
