Abstract:
Law and regulation are examined as sister fields which provide important frameworks and perspectives for understanding drugs and society. The chapter argues, first, that legal scholarship on drugs is considerably under-developed and presents an outline structure for building a comprehensive field of law centring on drugs: spanning across international law, human rights and constitutional law, criminal law and property law. It also looks at law as a tool for change, specifically the area of strategic litigation. It then examines the interdisciplinary field of regulation studies and explores how viewing the drug problem through the lens of regulation opens up new insights and new directions for research. Lastly, it highlights the importance and necessity of understanding law and regulation as closely connected, rather than as distinct frames or domains.
