Abstract:
This chapter addresses the calculation of, and exceptions to, the time limits prescribed under the Common Regulations of the Hague System. It explains Rule 4, which governs the computation of periods expressed in years, months and days, and the rules applicable when a period expires on a day on which the International Bureau or the Office concerned is closed to the public, illustrated with worked examples. It then turns to Rule 5 on the excuse of delay in meeting time limits, originally limited to postal failures and now extended to force majeure events such as war, revolution, civil disorder, strikes, natural calamities and epidemics – including the Covid-19 pandemic. The chapter sets out the evidentiary requirements and the six-month outer limit, notes the exclusion of the second-part individual designation fee, and considers proposals to broaden the rule along the lines of Rule 5bis of the Madrid Regulations.
