Abstract: Several national constitutions have entrenched textual commitments to protect the interests of animals. Judicial recognition of animal interests is also increasing, even in the constitutional jurisprudence of jurisdictions without such explicit commitments. Existing constitutional animal protection provisions are welfarist, generally taking the form of directive principles that do not recognize justiciable animal rights. Other constitutional vehicles for protecting animal interests include environmental protection provisions and rights in habeas corpus, each of which has attracted critical commentary. Emerging research addresses the relationship between animals and unwritten constitutional principles and values, including the rule of law.
