Abstract:
Globally, consumers are increasingly turning to plant-based versions of animal products. These plant-based analogues of meat and dairy are often marketed using terms that correspond to the animal product name. Several US states have restricted plant-based food manufacturers from labelling products with terms traditionally used by animal product manufacturers through regulations. Plant-based manufacturers have challenged such regulations with varied success. Relatedly, consumers have sued plant-based food manufacturers, alleging that their labels are either deceptive, noncompliant with the ‘standard of identity’ for milk, or ‘misbranded’ under the Food, Drug & Cosmetic Act.
