Abstract:
Australian animal law is found primarily in the animal protection legislation of the nation's eight states and territories, with national legislation largely confined to live export and trade-related issues; thus, there is no nationally consistent body of animal law. Key areas of animal protection, including for farm and research animals, are, in practice, regulated by codes of practice adopted as regulations under primary statutes. There has been comparatively little public interest litigation in Australia addressing the interests of animals. While freedom of political communication is constitutionally protected, including around issues of animal welfare, this has not deterred parliaments at all levels from passing legislation restricting farm animal advocacy.
