Abstract:
Animal law in Kenya encompasses legislative enactments, administrative policies and regulations, treaties to which Kenya is a signatory, judicial decisions by superior courts, the common law of England in force as of 1897 and African customs insofar as those customs are not inconsistent with the written law. Animals are deemed property that can be mortgaged under the law. Kenyan criminal law prohibits cruelty, and civil law provides for various liabilities relating to animals. The national government is required to undertake the protection of the environment and natural resources, and County Assemblies legislate on a variety of local issues related to animals. Finally, there has been an incremental growth in jurisprudence by the courts regarding animal law.
