Owner liability for harm caused by animals in the US

Thomas Mugavero

Chapter 87 in Elgar Concise Encyclopedia of Animal Law, 2025, pp 335-337 from Edward Elgar Publishing

Abstract: In the US, the degree of liability imposed on animal owners for damage caused by the animal is dependent upon the type of animal, the way such animal is being employed, and the setting where such animal might be found. Thus, livestock (such as cattle or sheep) kept behind a fence is treated differently from the same livestock being herded on the road; by the same token, livestock is treated differently from domesticated pets or wild animals. Overall, the courts have sought to balance the natural tendencies of animals against the owner's ability to control or curb those tendencies.
