Abstract:
This chapter explores the evolution of European Union (EU) governance in gender equality and LGBTQI rights, and its constituent components—primary and secondary laws, soft law instruments, and case law. Tracing the historical development of gender equality and LGBTQI rights within the EU, the chapter highlights early commitments, the impact of EU enlargements, and new challenges emerging from the 2007 Treaty of Lisbon. Recent developments are then addressed by engaging with changing dynamics within EU institutions, such as radical right and populist groups in the European Parliament, activities by the first von der Leyen Commission, and heightened polarization within the Council. The EU's governance on LGBTQI rights and gender equality is further explored regarding developments in Poland and Hungary, and in human rights and external relations policies. These cases reveal the limitations and complexities of EU governance in gender equality and LGBTQI rights when supranational stances confront member-state interests.
