Sovereignty's trajectory within the bounds of modern democratic constitutionalism

Abstract: This chapter analyzes the trajectory of constitution-based sovereignty within the framework of modern democratic constitutionalism. It critically evaluates the advantages and limitations of this model, which supplanted the divine sovereignty of absolute monarchs with the sovereignty of the people, the nation, or the state. The discussion examines how sovereignty fares in relation to the four foundational pillars of democratic constitutionalism: the limitation of governmental powers, adherence to the rule of law, protection of fundamental rights, and the maintenance of a robust level of democratic participation.
