Proving corruption and defending the ‘corrupt’: setting the scene
John Hatchard ()
Chapter 1 in Proving Corruption and Defending the Corrupt, 2025, pp 1-8 from Edward Elgar Publishing
Abstract:
The criminalisation pillar in the United Nations Convention Against Corruption (UNCAC) and the African Union Convention on Preventing and Combating Corruption forms the foundation for combating corruption in Anglophone African countries. Its effectiveness depends on three Elements: Element 1: Ensuring a comprehensive set of corruption-related offences; Element 2: Providing a range of strategies and powers for effective corruption-related investigations and evidence gathering; and Element 3: Taking effective steps to facilitate the prosecution of corruption-related offences. This chapter outlines the scope of these Elements with a view to providing a detailed exploration of them throughout the book.
