Witness-related issues
John Hatchard ()
Chapter 12 in Proving Corruption and Defending the Corrupt, 2025, pp 229-263 from Edward Elgar Publishing
Abstract:
The special witness challenges that can arise in corruption-related cases are explored in this chapter. These include sole witnesses, the compellability of spouses, immunities, and forgetful and hostile witnesses. A major concern is addressing the need to protect whistleblowers/reporting persons and provide anonymity for them at corruption trials whilst seeking to uphold the right to confrontation. Suitable strategies for addressing the challenges are reviewed.
