Corruption proved? Dealing with the corruption ‘boulder’

Abstract: Proving corruption requires Anglophone African countries to commit to implementing the three Elements enshrined in the UNCAC criminalisation pillar. Defending the corrupt requires Anglophone African countries to ensure that accused persons enjoy the right to a fair trial and other constitutional rights, together with the application of the exclusionary rules of evidence. This book has demonstrated that there is still much to do in successfully implementing the three Elements. The starting point is the Golden Triangle and the fairness approach. These are designed to facilitate the enjoyment of constitutional rights and protections of the ‘corrupt’ whilst ensuring, so far as possible, that the rights of victims of corruption are duly considered and that the triangulation of interests is completed by ensuring the public interest is satisfied.
