Acts of infringement
Toshiko Takenaka
Chapter 12 in The Law and Theory of Patents, 2026, pp 263-293 from Edward Elgar Publishing
Abstract:
This chapter analyzes the scope of patent infringement by examining the acts that trigger liability, their territorial and temporal limits, and how doctrines adapt to technological and economic change. Grounded in TRIPS Article 28, it explains how systems define direct and indirect infringement while preserving the territorial principle that confines patent rights to the granting jurisdiction. As global supply chains, digital distribution, and computer‑implemented technologies blur geographic and functional boundaries, courts increasingly confront conduct involving multiple actors and jurisdictions.
