Abstract:
The chapter begins by noting that the legal systems vary across the ten ASEAN Member States (AMS), though all ten address the three pillars of competition law- anti-competitive agreements, abuse of dominance and anti-competitive mergers. It describes the process for the establishment of competition laws in each AMS and the scope of those laws. Many of the AMS use the expression ‘undertaking’ or a variant of that expression to describe the entities to which it applies. The chapter discusses the meaning of that expression under the competition law of the European Union, the concept of a commercial activity, the single economic entity inherent in that definition and the activities of a state which are outside the reach of competition law.The chapter also describes the extent to which the competition laws of each AMS apply to the activities of government, to state-owned enterprises and to conduct occurring outside the AMS- its extraterritorial application. The chapter concludes by describing the separate sectoral laws which extend to competition within each AMS.
