Abstract:
The chapter discusses the law in ASEAN Member States (AMS) that prohibit the abuse of a dominant position. It begins by exploring the meaning of dominance and what constitutes an abuse of dominance, relying on decisions from the European Union and other jurisdictions. It then examines the laws of each AMS that apply to an abuse of dominance. This includes guidelines which describe examples of an abuse of dominance including predatory pricing, exclusive dealing, price discrimination, refusals to supply and the treatment of intellectual property rights. The chapter also describes the process available in Singapore for seeking guidance from the Commission for conduct which may constitute and abuse of dominance.
