Abstract:
The chapter is in two sections. The first examines the prohibitions on anti-competitive mergers in each of the ASEAN Member States (AMS). It also examines the merger guidelines developed by ASEAN competition agencies which discuss their substantive approach to mergers, including market concentration thresholds, entry barriers, countervailing power and relevant counterfactuals. The second describes the requirements for notification of mergers in each AMS. Some impose mandatory pre-merger or post-merger notification obligations, while in some notification is voluntary. This section describes the thresholds for notification in each AMS, such as the size of the merger and the process for considering notification applications within each AMS.
