Chapter Chapter 9 in Competition Law in ASEAN, 2025, pp 471-528 from Edward Elgar Publishing
Abstract:
The chapter begins by describing the process by which complaints are received by the competition regulators of each ASEAN Member State (AMS) and the process and timelines for the investigation of those complaints, typically involving one or more phases of review. Some AMS also utilise specific investigators or other institutions to undertake an investigation and to consider evidence and other matters. The chapter describes the processes employed by those investigators. The chapter also discusses the powers available to competition regulators when conducting an investigation. Those powers include the power to require the production of documents and information and to enter and search premises (with or without a warrant). The power to impose interim measures during an investigation is addressed separately in Chapter 10.
