Regulating platform work in the European Union: initiatives, challenges and the ways ahead

Abstract:
This chapter analyses how the platform economy has been approached so far by the EU and national legislators across the member states. It argues that, while recent legislative initiatives constitute positive steps, they do not go far enough in providing rights to all those who are in need of protection. For this reason, the chapter advocates the need to re-examine the predominant normative paradigm according to which labour rights are anchored to the presence of a subordinate relationship between worker and employer. Alternative frameworks proposed in the literature – such as those of predominantly personal work; imbalance in bargaining power between the parties; involuntary assumption of business risks measured by inability to spread risks; and integrated economic activity – are analysed to illustrate how they can be used to guide regulatory intervention in the future.
