Strategic litigation and animal law development

Abstract: While the possibilities of bringing so-called abstract lawsuits were previously quite limited in the Nordic countries, recent legal developments have accepted more lawsuits that do not have direct consequences for specific legal entities but which concern the application of legal or regulatory provisions in general. This enables strategic litigation to a greater extent than before, which the judgment from the Norwegian Supreme Court in the “Dog Breeding Case” from 2023 is a good example of. This chapter is a case study from Norway, but similar developments have been observed in the other Nordic countries and in a number of other continental European states.
