Antidumping duties and safeguard tariffs

Abstract: Antidumping duties and safeguard tariffs constitute two types of contingent trade protective measures with the goal of restricting the import of goods or services from a specific foreign country. These protective measures are called contingent because of conditions that need to be met before they can be implemented. In contrast to tariffs and quotas, they provide temporary import relief for the protected industries, although both can be renewed if necessary. Given the vagueness of the conditionality terms, antidumping duties and safeguard tariffs stand at the crosshairs between legitimate protection of domestic producers from foreign actors bending the rules of national and international trade laws and blatant forms of protectionism for underperforming industries unable to compete with foreign rivals. In contrast to the less often used safeguards, antidumping duties have become the preeminent tool of WTO countries to implement trade restrictions on other members since the 1980s.
