Chapter 7 in A Research Agenda for Emerging Markets, 2026, pp 87-104 from Edward Elgar Publishing

Abstract: Intellectual property (IP) protection is a critical challenge for all firms in developing countries, where underdeveloped legal systems and weak enforcement threaten companies with heightened risks of patent infringement, counterfeiting, and digital piracy. Research shows that counterfeit and pirated goods accounted for three percent of global trade by 2019, with these challenges especially grave in China, India, and parts of Latin America. This chapter explores three key issues: the core IP challenges in these markets, the duality of developing countries as both sources and targets of IP infringement, and effective strategies for managing IP risks. Drawing on institutional theory, the resource-based view, and transaction cost economics, the chapter emphasizes adaptive, agile approaches to IP protection in developing countries for DMNCs and local competitors alike.
