Introduction

Juan Ruiz Ramos ()

A chapter in The Freedom of Movement of Asylum Seekers within the State, 2025, pp 1-25 from Edward Elgar Publishing

Abstract: This Introduction provides an overview of the two types of restrictive measures that European States have imposed on the movement of asylum seekers in recent decades: area-based restrictions and restrictions resembling detention. It explains the importance of the right to free movement within the country in the context of these practices and how the book will address this right. It continues by setting the scope of the research, reflecting on why certain provisions (Article 8 ECHR) and legal instruments (the EU Charter) have been excluded from the study. It then describes the theoretical pillars of the book (multi-sourced equivalent norms and migration exceptionalism) and briefly discusses its methodological approach. The Introduction concludes with an outline of the structure of the book.
