The regulation of Video 4.0

Abstract: The chapter explores the regulation of Video 4.0, the next generation of video media. One can expect problems, some traditional, others new. There are various approaches to public policy in this area, including government support, reliance on existing laws, company and industry self-regulation, direct government regulation, consumer self-protection through AI technology, international agreements, antitrust measures, and public ownership of platforms. A hybrid, delegated regulation creates other problems by empowering the largest platform companies. There are particular challenges in regulating Video 4.0, including defining liability, protecting free speech, and addressing concerns surrounding market power, societal obligations, and objectionable content. Often, existing regulations may be adequate to address concerns, and new issues can be resolved through courts and regulatory agencies, creating a “Common Law” of AI and Video 4.0.
