Abstract: Continuing along the methodological path outlined in the four-step guide, Chapter 3 examines the who and when factors, thus offering insight into the institutional and temporal aspects of the moral evaluation of inventions. The analysis explores procedural nuances of patent examination at the pre- and post-grant stages, as well as the unique architecture of the Unitary Patent System. Since the primary goal of the new theory is to provide a universal tool for supranational authorities within the European patent system, it is essential to understand their responsibilities, composition and expertise, alongside their role in patent proceedings. While providing a comprehensive overview of institutions engaged in the moral assessment of inventions through different stages of a patent's life, particular emphasis is placed on the detailed analysis of the structure and functions of the Unified Patent Court.
