The unsustainable patchwork of research exceptions in European copyright law: insights from the I-REx index

Abstract: The chapter examines the complex relationship between intellectual property rights (IPR), scientific research, and the Sustainable Development Goals (SDGs), focusing on copyright law in the European Union. The first part outlines the relationship between SDGs, IPRs, and research. It assesses IPR's impact on research and advocates for evidence-based policymaking. In the second part, the chapter presents conclusions on the fragmentation of research exceptions in EU copyright law and its impact on the SDGs. The I-REx index presents these conclusions by analyzing how these exceptions are harmonized in the legislation of EU member states. The findings show significant disparities, as countries impose additional restrictions that hinder access to scientific resources and limit international collaboration. Regulatory fragmentation undermines research effectiveness, which is essential for sustainable development, and hampers SDGs implementation. It calls for a more harmonized framework that promotes research and innovation for future generations.
