Ethical aspects and intellectual property compliance

Abstract: The nature and scope of IP compliance is greater in research and development particularly in a distributed network. The increase in joint work/research necessitates the inclusion of ethical principles as part of IP compliance. The study analyzes the interpretation of joint inventorship and authorship under IP legislations vis-a-vis individual IP policies of institutions. The development of ethical guidelines in academic-institute and academic-industry collaborations were analyzed. The analysis indicates the development of guidelines for ethics in research and governance and their implementation in an institutional context. There are constraints in determining authorship and inventorship where there are no record-book policies. The inculcation of ethical principles is observed to assist in the pre-IP process and address challenges in declaration mechanism for authorship and inventorship. The findings reveal the need for inclusion of ethical principles in IP policies and interlink the R&D, IP policy for their sustained implementation within and across academic organizations.
