Abstract:
This chapter argues against a general application of relevant copyright exceptions (pastiche) and the fundamental right to freedom of art and expression to artefacts produced by (fully automated) AI applications. The chapter specifically considers how recent theoretical approaches towards notions of collective fundamental rights, especially in light of collective user expectations on platforms, need to be corrected through a clearer notion of freedom of art understood as a negative libertarian right to provide human artists with a dedicated right to object.
