Chapter 1 in Parallel Framework Agreements in EU Public Procurement Law, 2026, pp 2-30 from Edward Elgar Publishing

Abstract: Parallel framework agreements are used in procurement practice, yet they have not been explicitly addressed by the EU legislator or the CJEU. This chapter lays the foundation for the analysis developed throughout the book. It introduces the concept of parallel framework agreements and draws on national case law to illustrate divergent practices regarding concurrent procurement from overlapping frameworks. The chapter then discusses the legal challenges arising from these arrangements. It outlines the book's objective of bridging the gap between EU public procurement law and procurement practices at the national level. Finally, it sets out the key research questions, the overall structure of the book, and methodology providing a basis for examining the legal implications of parallel framework agreements in public procurement.
