Abstract: Framework agreements were regulated at EU level for the first time in 2004. Since then, they have become an increasingly popular procurement technique, with a growing number of contracting authorities relying on them to centralise their purchases. However, in the more than twenty years since their introduction, the legal rules governing framework agreements have remained largely unchanged, while procurement practices have evolved beyond the scope of the existing regulation. This chapter outlines the current EU rules on framework agreements with the aim of highlighting the inconsistencies between the legal framework and actual practice. It reviews the relevant legislation and recent case law, providing a basis for the later analysis of parallel framework agreements. As the subsequent chapters build on existing legislation, doctrine and jurisprudence, this chapter serves as a reference point, avoiding the need to repeatedly define or explain the concept of framework agreements. The chapter also offers a critical assessment of the regulatory framework, identifying inconsistencies and highlighting key shortcomings in the treatment of framework agreements under Directive 2014/24/EU.
