Abstract:
This chapter examines the applicability of the EU Charter of Fundamental Rights to the ECB in the context of the digital euro, focusing on accessibility and privacy. Accessibility is linked to the rights of non-discrimination and universal access to legal tender. While the digital euro seeks to enhance financial inclusion, digital exclusion remains a challenge, especially for vulnerable groups like the elderly and those with limited digital skills. The role of secondary legislation, including digital accessibility directives, is considered in ensuring equitable access. Privacy is explored through articles 7 and 8 of the Charter and the (EU)-GDPR, emphasizing data minimization, security, and privacy-by-design in the digital euro's development. The chapter highlights balancing privacy protections with the ECB's independence and financial stability mandate. It concludes by stressing the importance of embedding fundamental rights in the digital euro's design to prevent exclusion and safeguard privacy, setting the stage for the next chapter on criticisms including social credit concerns.
