Constitutional Reforms and Their Effect on Public Investment: A Political Economy Approach

Abstract: This paper investigates the complex relationship between constitutional reforms and the level, efficiency, and distribution of public investment. Moving beyond a purely economic or legalistic analysis, it adopts a political economy framework to argue that constitutions are not neutral documents but rather institutions that structure political power and create incentives for rulers. The central thesis is that constitutional reforms which strengthen constraints on executive power, enhance fiscal rules, decentralize authority, and secure property rights tend to foster a more stable, credible, and productive environment for public investment in the long run. However, the short-to-medium-term effects are often contested and can lead to political gridlock or a reallocation of investment for political, rather than economic, ends. Through a review of theoretical literature and illustrative case studies, this paper demonstrates that the ultimate effect of constitutional change on public investment is mediated by the pre-existing political settlement, the strength of enforcement mechanisms, and the nature of the reform itself.
