Why Net-Zero, Safety, and Reform Pledges Fail: A Binding Architecture Perspective

Abstract:
Across climate policy, industrial safety and institutional reform, the same pattern recurs: commitments are made publicly, monitored extensively, restated after failure, and not met. The dominant explanations — insufficient ambition, weak political will, inadequate enforcement capacity — describe features of particular cases without explaining why the pattern is invariant across domains with entirely different actors, incentives and stakes. This paper applies the binding architecture of Ghadamian to three such domains and finds the same structural signature in each. Failed commitments share five conditions: temporal asymmetry between the commitment horizon and the institution's decision cycle; non-binding design; bypassability through alternative compliance pathways; verification without consequence; and legitimacy substitution, in which institutional standing is accepted in place of the enforcement architecture that standing was supposed to guarantee. The diagnosis is architectural rather than moral, and it yields an ex ante test: whether a commitment will bind is determinable at the moment it is made, from its construction alone, without reference to the sincerity of those making it or the outcome that eventually follows.
