Abstract:
The "Principles of European Law" and the italian Civil Code. Some preliminary remarks (di Guido Alpa) - ABSTRACT: The editing project of an European Civil Code for all the EC Countries goes on phase by phase: in the first phase, just finished, the contract rules have been disposed. A lot of them are similar to those of the Italian Civil Code. Other rules are inspired to the principles of International Commerce of Unidroit. The terms and the contents show the compromise between continental tradition (French and German) and common law tradition. In the next phases the Commission will dispose the rules dealing with civil liabilities and the other obligation sources.
