Abstract:
This article discusses the evolution of court decisions on the employer's security obligation from 2000 to 2020. This development is impacting the field of risk management. From a obligation of result to a duty of care, the employer must put in place the means to ensure the safety of employees. It is then encouraged to develop safety diligence by taking into account court decisions that call for collective participation in risk assessment. The two fields (management science and law) are being brought into tension, leading to significant managerial impacts. This is particularly noteworthy when one looks at the current risk of employee contamination at SARS-CoV-2.
