Abstract:
This article discuss intellectual property policies in Brazil, as compared to policies inhealth and agriculture after the TRIPS Agreement.It article concerns intellectual property as an institution to make it easier thecontrol, valorization and spread assets based on innovations. Making use of neoschumpeterianconceptual framework, this article discusses the implications of intellectualproperty applied to innovations in agriculture and health. It analysis thecontemporary trends of intellectual property protection, and recently the consequencesof its implementation in Brazil. The consequences are treated at three main dimensions:protect varieties in seed and patents in pharmaceutical markets, law management,and coordination and articulation process. Public intervention in this markets arerelated to innovation patterns and to S&T&I policies.The methodology consists in t analysing of pharmaceutical ad seed market dataand the new institutional analysis, and also the intellectual property policies developedby Embrapa and Health Ministry.Considering the main results, it is possible emphasize the idiosyncratic impactsof the incentive of intellectual property in terms of sectors, industries and firms.Form this point of view the appropriation capacity will vary. The protection offer bythe intellectual protection fields (industrial property and breeders rights) are differentand articulated to scientific and industrial capacity and to the market structure. Inthis meaning the form and institutional structure of formulation and application ofpublic policies tends to vary their impacts in the economic sectors and fieldsof protection intellectual rights.
