 Parceria Trans-Pacífico: um acordo megarregional na fronteira da regulação do comércio internacional?No 2108, Discussion Papers from Instituto de Pesquisa Econômica Aplicada - IPEA Abstract: Este trabalho tem por objetivo traçar um panorama do Acordo de Parceria Trans-Pacífico (TPP), analisando sua formação e os principais temas que devem fazer parte do futuro acordo, e avaliando as perspectivas de conclusão e seus possíveis impactos, com foco especial sobre países em desenvolvimento que não fazem parte do acordo, como é o caso do Brasil. O TPP pretende ser um acordo do século XXI, abarcando não só a facilitação do acesso a mercados de bens, serviços e investimentos, mas também um conjunto de novas disciplinas que vão desde convergência regulatória e harmonização de padrões técnicos até princípios trabalhistas e medidas de conservação ambiental. Não obstante, a heterogeneidade dos membros e dos temas envolvidos, muitos deles ainda ausentes do arcabouço multilateral, além de bastante complexos e sujeitos a posições antagônicas entre os membros, coloca dúvida sobre a possibilidade de sucesso nas negociações, bem como sobre as feições do acordo final. Se bem-sucedido, contudo, os impactos do TPP provavelmente terão magnitude considerável. A depender do grau de sucesso em áreas como harmonização regulatória e regras de origem, é possível que o TPP funcione como um incentivo para que empresas voltem suas atividades para dentro do bloco, aprofundando a “regionalização” das cadeias de valor. O acordo pode ter efeito profundo também sobre o funcionamento do sistema multilateral de comércio, caso venha a enfraquecer o papel da Organização Mundial do Comércio (OMC) de principal lócus de criação do arcabouço normativo que rege o comércio internacional, o que pode ser particularmente nefasto para o Brasil, que está de fora da negociação não apenas do TPP, mas também de todas as iniciativas megarregionais. The aim of the article is to draw an overview of the Trans-Pacific Partnership Agreement (TPP), analyzing its formation and the main issues that will probably be part of the future agreement, and evaluating the perspectives for its conclusion and possible impacts, with special focus upon developing countries which are outside the deal, such as Brazil. The TPP aims to be a “XXIst century agreement”, covering not only market access for goods, services and investment, but also a new set of disciplines ranging from regulatory convergence and harmonization of technical standards to labor principles and measures for environmental conservation. Nevertheless, the heterogeneity that characterizes the members of the initiative, as well as the multiplicity and complexity of issues, many of them still absent of the multilateral framework, raises questions about the possibility of successful negotiations, as well as on the features of the final agreement. If successful, however, its effects will probably be of considerable magnitude. Depending on the degree of success in areas such as regulatory harmonization and rules of origin, it is possible that the TPP will work as an incentive to companies to turn their activities towards the block, deepening the regionalization of global value chains. The agreement can also have deep effects on the functioning of the multilateral trading system itself, should it weaken the role of the WTO main locus of rule-making on international trade, which may be particularly harmful to Brazil, outside not only of TPP but of all mega-regional initiatives.
