Insumos para a Regulamentação do Funget: informações sobre execuções na Justiça do Trabalho

Abstract: Este texto está focado em dois aspectos principais. Primeiramente, na apresentação de informações que permitam identificar os obstáculos enfrentados pelas execuções judiciais trabalhistas. Adicionalmente, na exposição de dados que ajudem a estimar o valor do passivo acumulado nas execuções não pagas. Sobre este último aspecto, o trabalho disponibiliza informações que ajudam a estimar o valor necessário para a estruturação financeira do Fundo Garantidor de Execuções Trabalhistas (Funget). Este fundo, criado na Reforma da Justiça (Emenda Constitucional no 45 de 2004), parece demandar um valor relativamente modesto, o que pode facilitar sua estruturação em um futuro próximo. This paper has two main purposes. Firstly, to provide information about the obstacles faced by Brazilian Labor Justice in making its decisions really effective. Secondly, to offer data which may help to estimate the amount of money involved in no-complied decisions. Regarding this, the paper provides information to calculate the amount necessary to implement Funget (a fund especially dedicated to improve the effectiveness of decisions in Labor Justice). This fund, created in the middle of the legal reform of Brazilian justice (Constitutional Amendment nº 45/2004), demands a modest amount of money, what may ease its implementation in the near future.
