A Atual Reforma Trabalhista: possibilidades, problemas e contradições

Abstract: A partir da década de 1930, o Estado brasileiro iniciou a construção de um sistema nacional de relações laborais. Nas décadas seguintes, este sistema passou por muitas alterações, juntamente com o próprio país (que se urbanizou, se industrializou etc.). No momento atual, está-se frente a uma nova onda de alterações no sistema de relações laborais, que neste texto será analisado apenas em seus aspectos mais diretamente relacionados à esfera do trabalho. Esta nova onda, iniciada com um conjunto de proposições legislativas, deve alterar o equilíbrio existente entre proteções dos trabalhadores e liberdades dos empregadores. Assumindo a perspectiva das primeiras, esta pesquisa procura analisar as possibilidades abertas pela recém-aprovada Lei no 13.467/2017, bem como seus problemas e contradições. Since the 1930s, the Brazilian State has built a national system of labour relations. In the following decades, this system underwent many changes, as well the country itself (which became urbanized, industrialized etc.). At the present time, there is a new wave of changes in the labour relations system – which will be analyzed, in this article, only in its aspects more directly related to the work realm. This new wave, initiated with a set of legislative proposals, will alter the balance between workers’ protections and freedoms of employers. Assuming the perspective of the former, this article analyzes the possibilities opened by Law no 13.467/2017 (recently approved), as well as its problems and contradictions.
