Abstract: Sleekness arbitral process arises from the lack of solemnity of court proceedings taking place in an appropriate environment with preset times, the atmosphere in which the parties do not appear as irreducible and implacable enemies, but are encouraged by both referees and interests continue their business relationships, to reach a solution as quickly as transactional. The lack of formality of the proceedings before the arbitral tribunal is manifested in that hearing witnesses and experts shall be made without oath.
