Abstract: The liberalisation of job protection is an often mentioned proposal to increase labour market flexibility. It is applied on businesses which exceed a certain limit of employees. The thesis we want to examine is that this limit detains small businesses from hiring more employees. Changes in this limitation during the late 1990s are the basis for the estimation of this effect by using a regression discontinuity design. Local treatment effects can be estimated nonparametrically. This contribution is the first that uses the above-named amendments to control for self-selection with minimal assumptions of the model specification. The results correspond with earlier results which could not make out any employment repressive effects.
