Il giudice amministrativo di fronte alla privatizzazione

Abstract: In Italy, the privatization of public bodies, functions and services is placed under the jurisdiction of the administrative judge. This way, the privatization process has been questioned, through the extensive application of general rules of administrative law. The article criticizes this kind of judicial interpretation and suggests a more limited and case by case enforcement of public law rules.
