Abstract: Abstract This final chapter seeks to evaluate the adjudicatory regimes that have been described in the previous ten chapters, assessing them against a range of yardsticks. We approach this chapter tentatively for a number of reasons. First, and notwithstanding our efforts to compare and contrast institutional features using comparative models in Chapter 2, comparisons remain fraught with difficulty as we noted in our introductory chapter, principally because comparison invariably entails some lifting of institutions out of context, ignoring the fact that a country’s institutions reflect its context and history, as well as the political hue and public policy concerns of the country’s government of the day. As such, the yardsticks against which institutions and procedures are evaluated may only be partly commensurable.
