Property Complications

Chapter 9 in The National Freight Buy-Out, 1983, pp 102-109 from Palgrave Macmillan
Abstract:
Abstract That guarantee clause securing loans against a first mortgage on properties owned by the borrower is standard practice. In principle it is not very different from a building society mortgage on a house where the society can take possession of the property if the purchaser fails to keep up with his mortgage repayments. But it will come as no surprise that the property negotiations involved in the Consortium’s dealings with the banking syndicate were every bit as complicated as any other part of the whole story.
